Types of Defective Products
Defective drugs are one of the most common types of harmful products that are involved in lawsuits. The reason medication ends up causing so many serious injuries is that big-name pharmaceutical companies choose to put profits ahead of people’s safety. The powers that be may rush through testing to get their drug on the market as soon as possible, use false advertising to over promise effectiveness, or fail to include serious side effects and other important information on the warning labels. All of these actions may be considered negligent behavior in the event that consumers are seriously harmed after taking the drug.
Another type of defective product we see quite often is defective medical devices. For example, a prosthetic hip replacement may need to be removed due to poor design, or an aortic connector used in heart surgery fails to do its job and needs to be replaced with a revision surgery. When defective medical devices result in additional injury, there may be grounds for a claim against the manufacturer.
Even if the product has been through required testing and met the legal requirements for safety, the manufacturer may still be held liable for serious injuries that result from use. Inadequate warning labels are one of the reasons some users end up in the hospital.
